Terms of Service

These Terms of Service ("Terms") govern your access to and use of SociallyMCP (the "Service"). The Service is operated by SociallyMCP, VAT ID PL1182252988, ul. Marcina Kasprzaka 31/119, 01-234, Poland ("SociallyMCP", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SociallyMCP is a hosted Model Context Protocol (MCP) server that provides programmatic, read-only access to publicly available social media data (currently TikTok). It is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, or any other social network. All trademarks belong to their respective owners.

2. Eligibility and account

You must be at least 16 years old and able to enter a binding contract. You are responsible for keeping your account credentials and API keys secret, and for all activity under your account. Notify us promptly of any unauthorised use. You may revoke an API key from your dashboard at any time, which immediately stops its access.

3. Acceptable use

You agree that you will not:

  • use the Service unlawfully or in breach of any third party's rights or terms (including TikTok's terms);
  • attempt to circumvent rate limits, quotas, metering or security controls;
  • resell or redistribute raw access in a way that bypasses per-call metering;
  • use the data to identify, profile, harass or harm individuals, or for unlawful surveillance;
  • overload, disrupt or reverse-engineer the Service.

You are solely responsible for how you use the data you retrieve and for complying with applicable laws (including data-protection law).

4. Credits and billing

The Service is metered in credits: one tool call consumes one credit. Paid plans renew monthly until cancelled. When your monthly allowance is exhausted, calls are blocked until renewal or upgrade — there is no automatic overage charge. Prices are shown on the pricing page and may change with notice for future billing periods. Payments are processed by Stripe.

5. Cancellation and refunds

You can cancel anytime from the billing portal; cancellation takes effect at the end of the current billing period and you keep access until then. Because credits are a digital service supplied immediately, fees for credits already made available or consumed are non-refundable except where required by mandatory law. Where the EU right of withdrawal applies, you acknowledge that by starting to use the Service within the withdrawal period you request immediate performance and may lose that right to the extent the Service has been provided.

6. Data and intellectual property

We and our licensors own the Service, its software and branding. You retain responsibility for, and any rights you have in, the way you use the data you retrieve. The underlying social media data originates from public third-party sources; we grant you no ownership of it and make no claim to it.

7. Third-party data and availability

Data is sourced from public, third-party platforms that we do not control. It may be incomplete, delayed, inaccurate or change without notice, and access may be interrupted if upstream sources change. We do not guarantee uninterrupted availability or the accuracy or completeness of any data returned.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, SociallyMCP is not liable for any indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the Service. Our total aggregate liability for any claim is limited to the amount you paid us for the Service in the three months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under mandatory law.

10. Indemnity

You agree to indemnify and hold SociallyMCP harmless from claims, damages and costs arising from your use of the Service or your breach of these Terms or of applicable law.

11. Suspension and termination

We may suspend or terminate accounts that breach these Terms, abuse the Service, or create legal or security risk. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (e.g. IP, disclaimers, liability) will survive.

12. Governing law

These Terms are governed by the laws of Poland and applicable European Union law. Mandatory consumer-protection rules of your country of residence remain unaffected. Disputes are subject to the competent courts of Poland, without prejudice to any mandatory consumer jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date; continued use after changes take effect constitutes acceptance.
